Rich is right. Double sided knives have been illegal for a long time. For some reason it doesn't seem to have been policed. We don't need one anyway, an ike spike works just as well and the 15 year old brats won't steal that from your tub.
Claymore, spearguns have no legislation at all. They aren't classified as anything.

The Age mentioned spearguns were classified as controlled in the article earlier this week on the knife crackdown.

Greg, the laws relating to weapons are quite confused in Victoria, however according to DoJ and Vicpol, spearguns are classified as a controlled weapon meaning there is no specific legislation relating to their ownership or use, however you do need a valid reason to possess one.

Our weapon laws are an absolute disgrace, they are a knee-jerk reaction by governments that don't have a clue about how to address weapon crime (hell anybody can go to Bunnings, buy some steel, a hacksaw and a bastard file and make an illegal 'dagger' in an hour or so). It is a disturbing trend these days that legitimate users are being punished in a misguided attempt to control the 'rogue element.' We these poorly thought out and ineffectual laws all over the place these days such as the new "hoon laws" and p plate driver restrictions.

Rant over (for now)

I dive with a machete in my belt. It does way more damage than a bayonet or the Omer laser. I bought it at Aussie disposals for $9.95

For hacking your way through kelp jungles or for some other sinister purpose?

Having a machete on my belt makes me feel like a man, in and out of the water. Why waste money on the useless Anaconda knife when a machete is way more effective for routine undertakings such as breaking coconuts, scaring off junkies in Frankston, and looking like a cool 1980's action hero who means business. If they (the media) only saw me prancing around with it the way I do - often swinging it above my head while crying the Iriquois war chant, that would surely attract the kind of attention to the machete it so rightly deserves. Double edged knife is nothing! NOOOOTHING!!!

I know this is an old post but i have something to add.....
I got in trouble a bit over a year or so back with having a fishing knife in the car.
My FISHING KNIFE was sitting on the back seat of my car next to the squid jigs. I had been fishing like a wk before and had dumped my squiding stuff on the back seat of my car as it had started raining.
i forgot about it and by chance a cop pulled me over and saw the knife.
Now you'd think after I explained my story and with the fact that my fishing gear was on the seat of my car also, that you'd get off with a warning or something....no.....an %!^%hole cop says to me, "im gonna have to charge you with possessing a controlled weapon".
now considering the 2 cops that pulled me over had said, "dun worry bout it, it should be fine."(in the interview/statement thing where i had to explain why the knife was there) but then when they went outside, their boss told em to book me. didnt care about the facts or reasons. said it would be up to the courts to decide.

what happens in court you ask??!!??....
the very fine magistrate/judge/ "your honour"(really?? your honour??!! power trip!!!!) person decides that, "since the police officer had decided there was enough evidence to charge you, im going to have to find you guilty of possessing a controlled weapon".

NICE!!! now because 2 idiots...(one cop and one judge) decided they were to lazy to look over the facts, i was found guilty of possessing a controlled weapon!

Now that im getting into spearfishing, what the frick should i do? use a rubber knife??
Sometimes i think the world has gone too far....political correctness...woman's righ....not gonna go there...hahaha! Bit of common sense please!

Sorry for the rant,
Byong

Shit Byong that is full on.

I have on a occasions had a lone speargun in my car from taking it into the shop to be re-rigged or lending it to Rhino. Always thought that you would get off on the basis of common sense. Obviously common sense isn't common.

I do however think it would be hard for the police to differentiate between a genuine fishermen from someone carrying a knife and a few squid jigs though. Bottom line is we should all probably take extra precautions when travelling with this sort of gear considering how they are perceived by law enforcement and the general community.

Despite the added cost, maybe it is worth getting an Australian Knife Collector membership. It's cheaper than going through the courts once you add in lost work-time etc.

byong, what kind of knife was it exactly? was it the supposedly illegal double edged kind we all use for spearfishing, or like a filleting knife? fishing knife is a pretty broad term.
