byong, what kind of knife was it exactly? was it the supposedly illegal double edged kind we all use for spearfishing, or like a filleting knife? fishing knife is a pretty broad term.

That is pretty bad mate - you got that with you for life now. They are obvioulsy exercising the "no tolerance" appraoch re: the new knife laws. Before these laws you probaly would have appealed/not have gotten the conviction (sorry not sure if you did get one) but you probably have close to zero chance now, even with a good lawyer. They don't care, they will simply apply them and make an example of you, there are no defences for this at the moment as far as I am aware (but some will have to exist in the future - I mean how do you buy a f@%^g knife in peace, show them a docket?): you have become a figure in a statistic used to support the belief that politicians are "doing something about it".

I wouldn't worry too much, if it ever came up in the future I am sure that people would be a lot more reasonable than the moron cop and judge. It obviously wasn't a double edged blade or the !@#$wits would have probably gone for an illegal weapon charge instead. What kids need is more freedom to make small mistakes as kids, not ineffectual regulations by governments to make them look like they are doing something when these 'kids' royally screw up and kill or badly injure someone as adults.

Personally I am worried. Along with tons of other people my job requires a police check and something like this could have an impact on my future employment.

Surely it would be a different story if the knife was in a dive bag and you were heading to/from a dive (damp wettie, etc).

Dave, there are two issues here; whether you are justified in having the knife and whether you are 'possessing' it. You must be engaged (not about to be, or returning from) an activity that requires the use of the knife. You could have argued that you were not in possession because a) you were neither carrying or using the weapon, b) it was not within reach therefore should not be considered 'in possession,' c) it was secured within a vehicle.

There is a serious problem in that there is no distinction between careless storage of a knife, and somebody deliberately carrying one as a weapon, thus if someone sees it in a record they will probably assume the latter. Again, it just goes to show the complete incompetence of our government and law enforcement in addressing this issue, punishing those who try to do the right thing.

yeah it was a fillet knife.
the cop said that unless i had just come back or was just going fishing, that there is no excuse for carrying a knife in the car.
not sure what the terms are, but its classified as a controlled weapon? dunno what that means.
the lucky thing is, i didnt get a conviction. it was a guilty plea with no conviction.
but the fine was pretty hefty!! think it was $800ish. not the best considering im doin my apprenticeship! hahaha!

NICE!!! now because 2 idiots...(one cop and one judge) decided they were to lazy to look over the facts, i was found guilty of possessing a controlled weapon!

Now that im getting into spearfishing, what the frick should i do? use a rubber knife??
Sometimes i think the world has gone too far....political correctness...woman's righ....not gonna go there...hahaha! Bit of common sense please!

On the topic of over regulation and lack of commonsense, I got asked for ID when buying a squid jig from Big-W last week :shock: :shock: . Apparently they are classed as a 'dangerous weapon' and I needed to prove my age(Im 27..lol) :shock: :shock:

Thought I heard of this drama a while back, from memory not much came out of it and shops keep selling them as law enforcement didnt seem to really care that much.
In my opinion ceramic and polymer knives pose a higher risk to society then a spearo dagger.

why the care about this is beyond me ... anyone seen these tasers bulit like a flashlight they get them thru customs very easy ... they got enough power to take down a cow

or the fibreglass daggers they miss all metal detectors ..... look out clubs, pubs, aircraft, music concerts

bcf are still today selling these double sided knifes but like the spearguns they sell u need id...

I was in south africa almost a year ago and picked up some dive gear over there. I happened to purchase A rob allen kinife pretty well identical to the one in the age article. I also had about 5 or 6 guns and a few other bits and pieces and brought them back through customs with out an issue. I was simply asked if the guns were pneumatic and then sent on my way. So it is clearly media hype bullshit. However I should probably remove my dive knife from the back seat of my car, but then I seem to have taken oska's quote to heart and my car is such a mess that if I did get pulled over it'd take the coppa atleast an hour to find the thing. hehe.
