I was having a read and found on the DPI site;
"You must not use any equipment, device or tool other than recreational hoop nets for the taking of rocklobster. You may use breathing apparatus to breathe under water. You must not use or possess, while engaged in underwater fishing for rocklobster, any snare, gaff, hook or other device designed for, or capable of taking any fish. A snare is commercial fishing equipment and must not be possessed by recreational fishers."

Does this include spearguns? AKA, if I take the boat out to the back beaches off Sorrento, can I take a speargun to get a few fish as well providing they are not used to take crays (or leave my fishing gaff in the boat for that matter), or must I take out all of these items if I want to take crays?

this is only a guess, but i would think that if a fisherys officer came and looked at your catch and there was no hole in the crayfish from a gun or gaff, they wouldnt care if you had a gun and/or gaff in your boat or attached to your float...?
not sure tho.

It's fine having any legal fishing equip in your boat, But whilst physically taking the cray you are not allowed to have any implement to assist in taking it. So clip your spear gun to your float, go down and grab your cray.

If the fisheries were to pin you for having having catch of crays in your boat & having spearing equip its kinda like Guilty to proven innocent isn't it?

That is the problem with regards to fisheries, you have to prove that you are innocent rather than the other way around. Common sense would say that if the cray doesn't have a hole in it, chances are a speargun wasn't used, but then State Government bodies aren't renowned for that sort of thing.

I've asked fisheries about this and their isn't an issue carrying a speargun while hunting crays. I've been check plenty of times with crays in my bag and speargun in hand and have never had a problem.
Just dont use a noose or hook, dont shot a cray, don't prise them out with your gun, and don't use a device for holding berly in place.

Matt you mean a anchor that you could attach a fish to and place at a ledge is not allowed?

technically no, you couldn't put a bit of fish on a stick and coax it out.
Instead I use big long chunks of cuda! works realy well! they seem to love the oily flesh of them..........

thats a little rough, I mean you can go put a pot out and bait it, but you can't anchor some bait to aid you in catching one by hand?
